    PREFACE

    This Code constitutes a recodification of the general and permanent ordinances of the Village of Skokie, Illinois.

    Source materials used in the preparation of the Code were the 1979 Code, as supplemented through 1999, and ordinances subsequently adopted by the Mayor and Board of Trustees. The source of each section is included in the history note appearing in parentheses at the end thereof. By use of the comparative tables appearing in the back of this Code, the reader can locate any section of the 1979 Code, as supplemented, and any subsequent ordinance included herein.

    The chapters of the Code have been conveniently arranged in alphabetical order, and the various sections within each chapter have been catchlined to facilitate usage. Notes which tie related sections of the Code together and which refer to relevant State law have been included. A table listing the State law citations and setting forth their location within the Code is included at the back of this Code.

    Chapter and Section Numbering System

    The chapter and section numbering system used in this Code is the same system used in many state and local government codes. Each section number consists of two parts separated by a dash. The figure before the dash refers to the chapter number, and the figure after the dash refers to the position of the section within the chapter. Thus, the second section of Chapter 1 is numbered 1-2, and the first section of Chapter 6 is 6-1. Under this system, each section is identified with its chapter, and at the same time new sections can be inserted in their proper place by using the decimal system for amendments. For example, if new material consisting of one section that would logically come between Sections 6-1 and 6-2 is desired to be added, such new section would be numbered 6-1.5. New articles and new divisions may be included in the same way or, in the case of articles, may be placed at the end of the chapter embracing the subject, and, in the case of divisions, may be placed at the end of the article embracing the subject. The next successive number shall be assigned to the new article or division. New chapters may be included by using one of the reserved chapter numbers. Care should be taken that the alphabetical arrangement of chapters is maintained when including new chapters.

    Page Numbering System

    The page numbering system used in this Code is a prefix system. The letters to the left of the colon are an abbreviation which represents a certain portion of the volume. The number to the right of the colon represents the number of the page in that portion. In the case of a chapter of the Code, the number to the left of the colon indicates the number of the chapter. The following are typical parts of codes of ordinances, which may or may not appear in this Code at this time, and their corresponding prefixes:

    Index

    The index has been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the index itself which stand as guideposts to direct the user to the particular item in which the user is interested.

    Looseleaf Supplements

    A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendatory legislation will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.

    Keeping this publication up-to-date at all times will depend largely upon the holder of the publication. As revised pages are received, it will then become the responsibility of the holder to have the amendments inserted according to the attached instructions. It is strongly recommended by the publisher that all such amendments be inserted immediately upon receipt to avoid misplacing them and, in addition, that all deleted pages be saved and filed for historical reference purposes.

    ADOPTING ORDINANCE

    ORDINANCE NO. 02-4-C-3077

    An Ordinance Revising, Amending, Enacting, Codifying and Consolidating the General Ordinances of the Village of Skokie, Illinois, Providing for the Repeal of Ordinances Not Included Therein, With Certain Exceptions, and for Other Purposes

    WHEREAS, the Village of Skokie is an Illinois home rule municipality pursuant to Article VII, Section 6, of the Illinois Constitution 1970; and

    WHEREAS, on June 11, 1979 the Mayor and Board of Trustees of the Village of Skokie adopted the recodification of the Code of Ordinances for the Village of Skokie (Skokie Village Code, 1979); and

    WHEREAS, the Corporation Counsel and Village Manger recommended to the Mayor and Board of Trustees, at a public meeting duly held, that the Village Code be updated and that the Mayor and Board of Trustees adopt the recodification of the Code of Ordinances; and

    WHEREAS, the Mayor and Board of Trustees concurred in the aforesaid recommendation;

    NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Skokie, Cook County, Illinois:

    Section 1: For the purposes of revising, amending, enacting, codifying and consolidating the general ordinances and laws of the Village of Skokie, Illinois, and pursuant to the home rule powers granted to the Village of Skokie under the Constitution and Laws of the State of Illinois, the following chapters, to wit, Chapters 1 through 118, inclusive, attached hereto and incorporated by reference as if set forth verbatim herein, are hereby adopted and passed as and for the general ordinances of the Village of Skokie, Illinois, and shall constitute and be known as the "Skokie Village Code, 2002"

    Section 2: The provisions of the Skokie Village Code, 2002, shall take effect and be in force upon the passage, approval, and publication in pamphlet form by the Village Clerk as required by law.

    Section 3: The provisions appearing in the Skokie Village Code, 2002, insofar as they are substantially the same as those of the Skokie Village Code, 1979, regardless of their location and numbering, and those of all other ordinances existing at the time of the adoption of said Skokie Village Code, 2002, shall be construed as a continuation thereof and not as new enactments. Provisions of the Skokie Village Code, 1979, as amended through and including April 15, 2002, not set forth in the same or substantially the same form in the Skokie Village Code, 2002, except as hereafter provided, shall be deemed repealed by this Ordinance. Any ordinance amending the Skokie Village Code, 2002, adopted on or after April 16, 2002, shall be deemed to amend the Skokie Village Code, 2002. Where an ordinance adopted on or after April 16, 2002, amended any portion of the Skokie Village Code, 1979, which was renumbered or relocated so as to be retained and included as a successor provision of the Skokie Village Code, 2002, said ordinance shall be deemed to have amended the successor provision of the Skokie Village Code, 2002, wherever located.

    Section 4: The repeal provided for in Section 3 of this Ordinance shall not be deemed to repeal any ordinance not amending or having been codified into the Skokie Village Code, 2002.

    Section 5: The repeal provided for in Section 3 of this Ordinance shall not be deemed to repeal the Zoning Regulations as contained in the Skokie Village Code, 1979, Chapter 21, as has been amended from time to time.

    Section 6: The repeal provided for in Section 3 of this Ordinance shall not be deemed to affect any offense or act committed or done or any penalty, forfeiture or punishment incurred or any claim, contract or right established or accruing before the effective date of this Ordinance; nor shall said repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the Village or authorizing the issuance of any bonds of the Village or any evidence of the Village's indebtedness, or any contract or obligation assumed by the Village; nor shall said repeal affect the administrative ordinances and resolutions of the Village not in conflict or inconsistent with the Skokie Village Code, 2002; nor shall said repeal affect any annual appropriation ordinance of the Village, any ordinance or resolution concerning, levying or imposing any tax or imposing any fee other than that set forth specifically in the Skokie Village Code, 2002; nor shall said repeal affect any ordinance or resolution relating to wages, salaries and bonds of any Village officer or employee; nor shall said repeal affect any right or franchise conferred by ordinance or resolution of the Village on any person or entity; nor shall said repeal affect any ordinance or resolution concerning or relating to the annexation or to extending or reducing the boundaries of the Village; nor shall said repeal affect any ordinance or resolution establishing the grades of streets and avenues and the several railroad tracks in the Village; nor shall said repeal affect any ordinance or resolution establishing, naming or vacating any street, alley or other place or assuming jurisdiction over same; nor shall said repeal affect any ordinance or resolution relating to or granting powers to other governmental entities or relating in any way to the construction, operation and maintenance of the Village's water supply or sewer system, or any other municipal utility; nor shall said repeal affect any ordinance or resolution concerning the transfer of prisoners to places of accommodation, elections, zoning ordinances or variations or special uses granted pursuant thereto, the transfer, acceptance, lease, sale or purchase of any real or personal property, or any ordinance or resolution concerning special assessments or special taxing districts; nor shall said repeal affect any prosecution, suit or other proceeding pending or any judgment rendered prior to the effective date of this Ordinance.

    Section 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
